Legal Framework
The legal framework for trust services and electronic identification in the internal market of the European Union is currently enshrined inRegulation (EU) No 910/2014, on electronic identification and trust services for electronic transactions in the internal market, which advocates a harmonised legal regime, directly applicable in allMember States.
That Regulation aims to ensure the trust, legal certainty and cross-border interoperability of electronic transactions, ensuring that electronic means of identification and trust services are recognised and accepted throughout the European Union.
In this context,the EIDAS Regulationestablishes, inter alia, the following fundamental legal principles and effects:
In the context oftechnological development and digital transformationthe internal market, the legal framework is currently under development through the initiative calledeIDAS 2.0, introducing a set of structural updates aimed at strengthening European digital identity, user sovereignty over your data and the expansion of qualified trust services.

Protection of personal data
Enhancing the security, privacy and control of personal data by the data subject in conjunction with the General Data Protection Regulation (GDPR)
European Wallet
The creation of the European Digital Identity Card, allowing citizens and legal persons to securely store, manage and share identification credentials and electronic attributes
Identity Ecosystem
The development of an interoperable European Union-wide digital identity ecosystem enabling the authentication and use of public and private services across borders
Attribute Certificates
The introduction of qualified electronic certificates of attributes for the certification of qualifications, rights or characteristics of natural and legal persons

In the national legal system, the EIDAS Regulation is complemented by Decree-Law No 12/2021 of 9 February, which ensures its implementation, establishing that electronic documents signed with a qualified electronic signature have a probatory value equivalent to that of documents with a handwritten signature under the Portuguese civil code.
